1. Service provider

The POLAR website and application (https://polardisorder.com) are operated by Miguel Amillategui. The contractual relationship is governed by applicable United States law and, on a supplementary basis, by the laws of the State of Delaware, Estados Unidos.

2. Description of the service

POLAR is a web application for tracking mood, sleep, medication, activity, energy, irritability and other wellness parameters, aimed at people with bipolar disorder and their support network (family, friends and healthcare professionals).

The service is offered under a freemium model: some features are free and others may require payment of a subscription or one-time fee, as indicated within the application.

3. Medical disclaimer

POLAR is not a medical device, does not provide diagnosis, and does not replace in any case the opinion, diagnosis or treatment of a qualified healthcare professional. Data, alerts, charts and reports generated by the application are for informational and personal tracking purposes only.

In case of severe symptoms, thoughts of self-harm, extreme agitation or any urgent clinical situation, you must contact emergency services or your doctor immediately. POLAR does not provide crisis care or immediate medical intervention.

4. Eligibility and minimum age

You must be at least 18 years old to create an account. If you are a minor in your jurisdiction, you may not use the service without the express consent and supervision of a parent or legal guardian, who will be responsible for your use of the application.

5. Account registration and security

You are responsible for keeping your credentials confidential and for all activity that occurs under your account. You must notify us immediately of any unauthorized use. POLAR may suspend or terminate accounts that violate these terms or pose a risk to the security of the service or other users.

6. Permitted and prohibited use

You may use POLAR for your personal tracking or, where applicable, as an authorized support-network member or healthcare professional invited by the account owner.

You may not:

Use the service for illegal, fraudulent or unauthorized purposes.
Attempt to access other users' accounts, intercept communications or compromise security.
Enter false data, impersonate others or generate misleading reports.
Reverse engineer, extract source code or use automated scraping.
Distribute malware, spam or offensive content through the service.

7. Content, data and reports

The data you enter into POLAR belongs to you. You authorize us to store, process and display it within the service to provide the contracted features. You may request export or deletion of your data by contacting m@amillategui.com.

Clinical reports, alerts and scores generated by POLAR are indicative. The user decides with whom to share them and assumes responsibility for information shared with family members, friends or healthcare professionals.

8. Intellectual property

Intellectual and industrial property rights in the software, design, POLAR trademark, texts, graphics and other site content belong to Miguel Amillategui or its licensors. No license is granted except as strictly necessary to use the service in accordance with these terms.

9. Pricing, payments and subscriptions

Paid features are offered under the freemium model. Prices, plans and billing frequency are shown within the application before purchase. Payments are processed through secure payment providers. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period.

Invoices are issued in accordance with applicable tax regulations. For individual taxpayers resident in Spain, invoices may include a 15% IRPF withholding on the taxable base unless otherwise stated.

10. Service modifications

POLAR may update, add or remove features in order to improve the experience, security or regulatory compliance. We will publish significant changes with reasonable advance notice when possible.

11. Limitation of liability

To the extent permitted by applicable law, Miguel Amillategui shall not be liable for medical decisions made with or without POLAR information, nor for indirect damages, lost profits, service interruptions or data loss arising from use or inability to use the application.

Total aggregate liability, except in cases of willful misconduct, gross negligence or legally mandatory strict liability, shall in no event exceed the total amount paid by the user in the twelve months preceding the causative event.

12. Termination

You may delete your account at any time from the application settings or by writing to m@amillategui.com. POLAR may also terminate or suspend access if you violate these terms or if necessary to protect the integrity of the service.

13. Governing law and jurisdiction

These terms are governed by the laws of the United States, and for dispute resolution the parties submit to the competent courts of the State of Delaware, without prejudice to any mandatory consumer jurisdiction recognized by the laws of your country of residence.

14. Changes to the terms

We will review these terms periodically. The date of the last update appears at the top of the page. Continued use of the service after changes are published constitutes acceptance of those changes.
